About practice
Tax is the most regulated and risky area for business: a mistake here costs not only a fine, but can also escalate into criminal proceedings under Article 212 of the Criminal Code of Ukraine. Therefore, the price of proper support is much lower than the price of a mistake noticed too late.
Lawyers of "Your Lawyer" have been working in the tax office since 2008. We support tax audits, appeal tax assessments administratively and in the administrative court, conduct VAT disputes, and defend in criminal proceedings for tax evasion. A separate area is tax planning and business structuring.
The principle of operation: it is better to consult before the event (request, check, optimization) than to defend yourself after the PPR and additional charges. But if the situation has already arisen - effective protection tools are available at every stage.
Support for tax audits
There are different types of inspections: desk-based (based on documents without the inspector's presence), scheduled documentary, unscheduled documentary, and actual (with on-site visits). Each has its own grounds, limitations, and payer's rights.
A lawyer for the inspection period is not a presence "for beauty", but a job: monitoring the legality of the appointment, checking the inspector's powers, responding to requests, recording violations, preparing written explanations. Because everything you say or sign during the inspection will later be used in the act - in one direction or another.
Appealing the PPR
The tax notice-decision (TD) is the result of the audit: the amount of additional tax liabilities and penalties. The payer has two levels of protection: an administrative appeal to the higher-level State Tax Service and a judicial appeal to the administrative court.
We prepare objections to the inspection report before issuing a PPR, a complaint in the administrative appeal procedure, a lawsuit to the district administrative court. In most cases, the combination of administrative level + judicial level works, because success at the administrative level allows you to avoid going to court, and loss does not block further judicial appeal.
VAT issues
A separate layer of work. Blocking of tax invoices of the Tax and Customs Administration - we prepare a table of payer data, explanations, if necessary - appeals. Budget VAT refund - support of the application, response to requests, appeals of refusals.
Registration and cancellation of VAT payers, refunds of overpayments from the budget, disputes regarding the reality of business transactions (especially in supply chains) - all this also applies to this practice.
Criminal tax cases
Article 212 of the Criminal Code of Ukraine (tax evasion) is the most common norm in tax criminal law. Next to it are Art. 358 (forgery of documents), Art. 366 (official forgery), legalization clauses. Often, criminal proceedings are opened in parallel with an administrative case, based on the same inspection acts.
We protect the suspect, witness, accused at all stages: pre-trial investigation, investigative actions, searches, interrogations, familiarization with materials, trial. We separately monitor the relationship with the administrative case - the outcome of one often affects the other.
Tax planning
Structuring a business for the optimal tax model - before problems arise. Choosing a taxation system (general, simplified, single group tax), choosing an organizational form, forming supply chains, currency control in foreign economic activity.
Separately - the transition between taxation systems, restructuring of a group of companies, analysis of planned transactions for tax consequences. This is work where a good result is measured not by a won dispute, but by a dispute that never arose.

Frequently asked questions
01 What to do when a request is received from the State Tax Service?
Do not ignore - the lack of a response to a legitimate request is in itself a reason for further action. But it is not worth responding "on all points" without analysis: the request often contains requirements that the payer is not obliged to respond to. First - a legal analysis of the request, then - a reasoned response within the legal time frame.
02 Is it possible to prevent the traffic police from conducting an actual inspection?
Depending on the legality of its appointment. Not allowing inspectors is a last resort with its own risks: the State Tax Service can use this as a basis for further action. First, we check the documents for the appointment of the inspection - order, powers, grounds. If there are no violations - the inspection should be allowed, but work with a lawyer.
03 What are the deadlines for appealing the PPR?
The deadlines are set by the Tax Code and differ for administrative and judicial appeals. We check the current deadlines at the time of application - the legislation changes periodically. The general rule: you need to react quickly, because a missed deadline closes one of the opportunities.
04 How does blocking tax invoices work?
The SMKOR system automatically stops the registration of tax invoices based on certain risk criteria. The payer must submit a data table, explanations, and documents confirming the reality of the transaction. If the blocking remains, appeal to the State Tax Service, then to the court. This is a common situation, the tools for dealing with it have been worked out.
05 Is criminal liability possible for tax evasion?
Yes - Art. 212 of the Criminal Code of Ukraine provides for criminal liability for tax evasion in significant, large and especially large amounts. The amounts and sanctions change periodically - we check the current version of the article at the time of application. A criminal case can be opened in parallel with the administrative process, so we build a comprehensive defense strategy.
