Division of property after divorce: when does the three-year statute of limitations begin?

Five years have passed since the divorce, and the apartment is still registered to the ex-husband. Has the right to a share been lost? The date of the divorce itself is not enough for such an answer. Part two of Article 72 of the Family Code of Ukraine establishes a three-year statute of limitations, but it is calculated from the day when the co-owner learned or could have learned about the violation of his property rights.

This difference has practical significance. Divorce terminates the personal relationship between the spouses, but does not abolish the regime of joint ownership of already acquired property. If the former spouses do not deny each other's rights, do not alienate the property or prevent its use, the three-year countdown may not yet begin.

Another situation arises when one of the co-owners sells the property without the consent of the other, claims personal ownership of all the property, does not allow anyone into the apartment, or refuses to voluntarily divide. Then the court will establish not only the date of the violation, but also the moment when the plaintiff learned about it or should have learned about it under the circumstances.

Why aren't three years automatically counted from the date of divorce?

Article 69 of the Civil Code of Ukraine allows a wife and husband to divide joint property regardless of the dissolution of the marriage. While the marriage is ongoing, the statute of limitations does not apply to the claim for the division of joint joint property. After a divorce, a special rule of part two of Article 72 of the Civil Code of Ukraine applies: the period is three years and begins from the day when the co-owner learned or could have learned about the violation of his right.

So, the law distinguishes two events. The first event, the dissolution of the marriage, opens the possibility of applying the statute of limitations. The second, the violation of property rights and awareness of it, triggers the running of the period. They may coincide, but this is not presumed.

In its ruling of March 27, 2024 in case No. 509/2196/15-ts, the Civil Court of Cassation within the Supreme Court reiterated the established approach. Failure to file a claim within three years after the dissolution of the marriage does not in itself prove a violation of the right, unless there is evidence that the other spouse denied the right to the property acquired during the marriage and registered in it. The Supreme Court overturned the decision of the court of appeal in part of the counterclaim, since the appeal did not establish the proper commencement of the limitation period.

Registration of an apartment for only one spouse also does not mean automatic loss of rights for the other. For property acquired during marriage, there is a presumption of joint ownership until the other party proves the personal nature of the property or another legal regime. It is necessary to separately check the source of funds, time of acquisition, marriage contract and other circumstances. This issue is addressed in the material on personal funds when buying an apartment in marriage.

Therefore, the answer “more than three years have passed since the divorce, it’s too late to sue” is legally incomplete. First, it is necessary to determine what right has been violated, who violated it, when it happened, and when the future plaintiff received or should have received reliable information about the violation.

What event can trigger the statute of limitations?

The start of the period depends on the specific behavior of the co-owner, and not on the formal family status. The violation must show that the right of the other spouse is not recognized or prevented from being exercised. For example, the registered owner refuses in writing to divide the apartment, calls it exclusively his own, changes the locks and does not allow another co-owner, sells the property or transfers it to a mortgage without the necessary consent.

The word "conflict" itself does not determine the start of the statute of limitations. Former spouses may not communicate for years, but agree that the apartment remains joint. Conversely, the right may be clearly denied on the day of divorce if one spouse immediately declares that the other does not own anything, and backs it up with actions.

The court analyzes the event in connection with the subject of the claim. Refusal to allow use of the dwelling may indicate a violation of the right of use and co-ownership. The sale of real estate raises separate questions about the consent of the other spouse, the good faith of the acquirer, the method of protection and compensation. A claim by the other spouse, in which all property is called personal, may reveal a denial of the right, but even a procedural act does not always automatically determine the beginning of the period.

This is evident from case No. 509/2196/15-ts. The Court of Appeal linked the person's awareness of the violation of the right with the filing of a motion to request evidence in an already open case. The Supreme Court found such a conclusion premature. The motion itself did not confirm that the other party denied the right to the disputed property. It was necessary to establish the actual event of the violation and the moment of awareness of it.

One should not artificially choose the most convenient later date, for example, the day of receiving a new extract from the register, if the sale was known earlier. Part one of Article 261 of the Civil Code of Ukraine takes into account not only actual knowledge, but also the moment when a person could have learned about the violation. The court will assess whether the information was available, whether the plaintiff received letters and documents, whether he participated in negotiations or another case, and why he did not react earlier.

Before filing a lawsuit, it is useful to draw up a chronology from the acquisition of each object to the first clear refusal to recognize the right. The general procedure and methods of dividing property in a divorce should be correlated with this chronology, and not only with the date of the court decision on the dissolution of the marriage.

What evidence can be used to confirm the beginning or absence of the period?

The claimant must explain when and under what circumstances he learned of the infringement. A defendant who seeks to invoke the statute of limitations will usually seek to prove prior knowledge. The court should not make assumptions about the date. Each version requires documents, electronic data or consistent explanations that are consistent with the other materials in the case.

The most convincing evidence is that which simultaneously records the content of the position and the date it was communicated to the other party. This may be a letter of refusal of voluntary division, a notice of sale, a response to a lawyer's request, a claim, a statement of claim, a protocol of negotiations, or an e-mail correspondence with a confirmed sender. Messages in the messenger require data that allows to establish the participants, the date, the integrity of the correspondence, and the connection to a specific property.

An extract from the State Register of Property Rights confirms the registration act and its date, but does not always prove when the other spouse learned about it. If the person was not a party to the transaction and did not receive a notification, the court will have to assess other circumstances. At the same time, referring only to the fact that the plaintiff "did not check the register" does not guarantee a late start of the term if he signed the related documents or knew about the transfer of property.

For a dispute over the use of an apartment, police reports, correspondence on the transfer of keys, management company documents, witness statements, and residence documents may be important. For a dispute over a vehicle, information from the Ministry of Internal Affairs service center, an alienation agreement, correspondence regarding the car, and evidence of receipt of funds will be important. The evidentiary model depends on the method of violation.

Equally important are materials showing the absence of a denial of the right. Joint payment of expenses, agreed use, discussion of a future sale as a joint asset, transfer of rental income or a draft division agreement may confirm that the parties still recognized a joint regime. However, each document should be read in context. Compensation negotiations sometimes already contain a refusal to recognize a share, rather than an affirmation of community.

Separately, it is necessary to collect evidence of the legal status of the property: the date of acquisition, the source of funds, contracts, bank statements, technical documents and information about improvements. The statute of limitations applies to a substantiated claim. If the property is not joint or the claim is not proven on the merits, a discussion about the term will not correct a weak legal position. The same applies to the division of marital debts : first, it is necessary to establish whether an obligation has arisen in the interests of the family, and only then analyze the term and method of protection.

How to calculate the period after the renewal of the statute of limitations on September 4, 2025

Even after determining the date of the violation of the right, it is not always enough to add three calendar years. The course of the limitation period was affected by special rules introduced during quarantine and martial law. They could extend or suspend the time limits, so for disputes with an ancient chronology, a separate calendar calculation is required.

On September 4, 2025, the Law of Ukraine No. 4434-IX came into force. It excluded paragraph 19 of the section “Final and Transitional Provisions” of the Civil Code of Ukraine, which provided for the suspension of the statute of limitations for the period of martial law. From this date, the running of the terms resumed, although martial law continued to be in effect. Therefore, in 2026, it cannot be assumed that the statute of limitations is still automatically “frozen.”

At the same time, the resumption of the course does not mean that previous periods of suspension should be ignored. For a claim to which the right was violated several years ago, it is necessary to consistently determine the starting date of the period, the time elapsed before the special rules came into effect, the periods of extension or suspension and the remainder of the period after September 4, 2025. A mechanical calculation of “three years from the divorce” or “three years from today” is equally risky.

It is also necessary to check Articles 263 and 264 of the Civil Code of Ukraine regarding the suspension and interruption of the statute of limitations if the case was subject to circumstances provided for by law or the other party committed actions that indicated the recognition of a right or obligation. For a dispute about the division of property, not every correspondence or negotiation will have such a consequence. The legal qualification of a specific action should be substantiated, and not just called it a "recognition."

The application for the expiry of the limitation period does not operate automatically. According to parts three and four of Article 267 of the Civil Code of Ukraine, the court applies it upon the application of a party to the dispute made before the decision is made. The expiry of the period is a ground for dismissal of the claim only after the court establishes the validity of the violated right, the proper commencement of the period and the absence of grounds for its protection despite the omission.

Due to the rule change in 2025, the statute of limitations should be attached to the statement of claim or defense as a separate calculation. It should include the events, the legal provisions, the duration of each period, and evidence of dates. This gives the court a testable model instead of a general statement that the statute of limitations “has not yet expired.”

What to check before filing a lawsuit for division of property

First, you need to create a complete list of assets and liabilities. For each object, record the date and reason for acquisition, registered owner, source of funds, current condition, and possible encumbrances. If the claim covers an apartment, a car, a share in a business, and compensation for property already sold, the start of the statute of limitations for different claims may differ.

Next, the first event that could indicate a violation of the right to each object is determined. It is necessary to separate the termination of family relations from the denial of property rights. The chronology should include not only dates that are favorable to the plaintiff, but also all the facts that the other party can refer to: letters received, negotiations, previous court cases, registration actions, change of access to property and alienation.

After that, the method of protection is chosen. Depending on the circumstances, the claim may contain demands for recognition of property as joint, division in kind, recognition of the right to a share, recovery of compensation or contestation of the transaction. An incorrectly chosen method of protection is not eliminated by proving the timeliness of the application. Within the framework of family law, the analysis of the property regime should be combined with a procedural assessment of the future dispute.

Before filing a claim, it is necessary to check whether the owner has changed and whether there is a mortgage, arrest or other encumbrance. For real estate, current information is obtained from the registry, for vehicles, data on registration actions are requested, for corporate rights, information from the Unified State Register and company documents are checked. If it is impossible to obtain evidence on your own, a lawyer can justify its request by the court or securing evidence.

You should not postpone the application just because the start date of the term is controversial. The court may not agree with a later date of awareness, and the property may be re-alienated during this time. Lawyer Valeriy Ponomarenko can assess the evidence and prospects of the dispute , prepare a calendar of limitations and determine the appropriate method of defense. If the dispute has already arisen, work with evidence should be built together with a strategy for legal defense.

Frequently asked questions

Is it possible to divide property ten years after a divorce?

Yes, this may be possible if the right to joint property was not previously violated or the plaintiff could not have known about the violation. The mere fact that ten years have passed since the divorce does not provide a definitive answer. The court will examine the specific event of the violation, awareness of it, and the rules for the running of the statute of limitations.

Does the period start if the apartment is registered only to the ex-husband or wife?

Not automatically. If the apartment was purchased during marriage, registration for one person does not in itself refute the joint ownership and does not necessarily mean denial of the rights of the other. Additional circumstances are required that indicate a violation.

Will the court apply the statute of limitations without a statement from the defendant?

No. Part three of Article 267 of the Civil Code of Ukraine provides for the application of the statute of limitations only upon a statement by a party to the dispute made before the court decision is made.

Is the statute of limitations suspended for the entire duration of martial law?

No. Law No. 4434-IX resumed the statute of limitations from September 4, 2025. For old claims, previous periods must be taken into account separately and the remaining period calculated.

What best proves the moment of the violation of the law?

The strongest evidence is a document or email that specifically states the denial of the right, the date, and the receipt of the information by the other co-owner. The final assessment depends on the totality of the evidence.

Visnovok

Three years for the division of property after a divorce are not counted from the date of the termination of the marriage, but from the day when the co-owner learned or could have learned about the violation of his right. The court needs a specific event and evidence of awareness of it. For old disputes, special rules that were in effect during quarantine and martial law, and the renewal of the statute of limitations from September 4, 2025, must be added to the calculation.
