An apartment purchased during marriage with personal funds: how to prove the source of the money

An apartment purchased during marriage is usually considered the joint property of the spouses. An entry in the register only for the husband or only for the wife does not cancel this rule. When dividing property, the presumption from Article 60 of the Family Code of Ukraine is the starting point: a thing purchased during marriage belongs to both.

However, the date of the contract is not the only criterion. Clause 3 of Part One of Article 57 of the Civil Code of Ukraine refers to personal private property as property acquired during marriage with funds that belonged to one of the spouses personally. This may be money from the sale of a premarital apartment, an inherited house or donated property. In a dispute, it is necessary to prove not only the origin of the money, but also that it was used for a specific purchase.

The weakest position is: "At that time, I had my own money, so the apartment is mine." The availability of funds and payment for the disputed object are different circumstances. A documentary chain is required between them: the right to the previous property, its sale, receipt of the price, preservation of funds, transfer or transfer to the seller of the new apartment. If part of the price was paid from the joint budget, the dispute already concerns not only the status of the apartment, but also the ratio of the personal and joint parts.

Why does the registration of one spouse not decide who owns the apartment?

Article 60 of the Civil Code of Ukraine does not link joint ownership to the person whose name is indicated in the contract or the State Register of Property Rights. If real estate is purchased during marriage, the court initially assumes that it is joint. It is also not decisive which of the spouses personally signed the contract or transferred money from their account. Earnings received during marriage, as a general rule, are included in joint property, even if they were received in a separate account.

This presumption makes it easier for the spouse who demands separation to prove it. It is usually sufficient for him to confirm the marriage and the purchase of an apartment during it. The person who insists on a personal property regime must rebut the presumption. The Grand Chamber of the Supreme Court, in its ruling of November 21, 2018 in case No. 372/504/17, indicated that the burden of proving the circumstances necessary for such rebuttal lies with the spouse who denies community of property.

The exception is expressly provided for in paragraph 3 of part one of Article 57 of the Code of Civil Procedure of Ukraine. Property may be personal, although it was purchased after the registration of the marriage, if the source was the personal money of the buyer. The status of the source must be established separately. For example, an apartment that a person had before marriage is his personal property. The money received from its sale does not become joint only because the sale took place during the marriage. At the same time, further mixing of this money with family income makes it difficult to prove its use.

The notarial consent of the other spouse to the purchase also does not provide an automatic answer. It may confirm awareness of the transaction or the performance of the notarial procedure, but the court evaluates it together with the contract, calculations and other evidence. The statement of the other spouse that the purchase is made with personal funds has much greater evidentiary weight if its content is specific and consistent with the movement of money.

Therefore, before dividing the property of spouses, it is necessary to separate three questions: when the apartment was purchased, who owned the funds, and how they ended up with the seller. The registration record mainly answers the first question about the title owner. The court determines the legal regime in relations between spouses based on the totality of circumstances.

How much money can a personal legal regime save?

The most obvious case occurs when one of the spouses sells property acquired before the marriage and directs the entire amount received to a new apartment. Property received as an inheritance or under a gift agreement during the marriage may also have a personal regime. Accordingly, the funds from the alienation of such an object may be a personal source of a new purchase, if the party proves their origin and use.

Money donated by parents requires special attention. An oral statement from relatives after a dispute arises may not be enough. The evidentiary position is much stronger when there is a written donation agreement, a bank transfer with a clear purpose, confirmation of the donor's financial capacity, and subsequent payment for the apartment from the recipient's account. If the parents transferred cash without documents, the court will have to evaluate indirect evidence, and the result becomes less predictable.

Funds in a personal bank account are not necessarily personal property. If they were accumulated from salary or business income during the marriage, a separate account does not change their legal status. Similarly, the sale of a shared apartment does not convert all the proceeds into the personal funds of the person in whose name the contract was drawn up.

The problem also arises after the mixing of funds. Suppose the money from the sale of a premarital home was transferred to an account where joint income was credited for several years, from which family expenses were paid, and then a new apartment was purchased. The bank balance itself no longer shows which part retained its personal origin. An analysis of statements, sequence of transactions, amounts and dates is required. The longer the period and the more intensive the movement in the account, the more difficult it is to prove the traceability of specific money.

Personal property may also change its legal regime under Article 62 of the Civil Code of Ukraine. If its value has increased significantly during the marriage due to joint labor or financial expenses or expenses of the other spouse, the court may, under certain circumstances, recognize it as joint joint property. This is a different issue than purchasing a new property with personal funds. In the first case, improvements to existing property are analyzed, in the second, the source of the price of the new thing is traced.

Family law practice covers both scenarios, but the evidence for them is different. For a new acquisition, contracts and payments are central. For a significant increase in value, data on the initial and final cost, the nature of the work, the costs and the causal link between them and the increase in the value of the property are required.

How to build an unbroken chain of evidence

The court does not evaluate a single document, but the entire sequence of transactions. The initial link is proof of personal right to the source of funds. For pre-marital real estate, this can be an old contract, certificate, extract from the register or court decision. For inheritance, a certificate of the right to inheritance is required, for a gift of property or money, an appropriate contract and confirmation of transfer are required.

The next step is to prove that the personal asset has been converted into cash. You will need a sales contract that lists the price, a bank statement, a receipt, or other document that shows actual payment. If the contract states full payment before signing but does not specify how the funds will be transferred, it confirms the sale, but may not explain the subsequent cash flow.

The third link connects the money received with the new apartment. The most convincing is the close chronology and coincidence of amounts: the sale of a personal object, the transfer of funds and the payment for the new housing took place sequentially, and the payment can be identified. In the resolution of February 2, 2022 in case No. 335/1576/20, the Supreme Court took into account, in particular, that the sale of a personal apartment and the purchase of the disputed one took place on the same day. In the resolution of January 22, 2020 in case No. 711/2302/18, the court also considered the purchase of an apartment with funds from the sale of personal property and confirmed that the time of purchase during marriage does not make the property absolutely joint.

It is advisable to compile documents into a chronological table before filing a claim or appeal. It should indicate the date, transaction, amount, account, document and what circumstance it confirms. Such a worksheet does not replace evidence, but it reveals gaps: price discrepancy, cash gap, different currency, long-term storage without confirmation or additional payment from an unknown source.

Testimony of the parties and relatives may supplement written evidence, but should not be the sole basis where the transaction was in documentary form. According to Articles 76-81 of the CPC of Ukraine, each party proves the circumstances to which it refers. The court assesses the relevance, admissibility, reliability of each piece of evidence and their sufficiency in aggregate. Concealing part of banking transactions or contradictory explanations can weaken even formally correct contracts.

If the necessary documents are held by a bank, notary or other person, you should assess in advance the possibility of obtaining them, and if necessary, ask the court to retrieve them. The procedure and terms of such a request are explained in detail in the article on retrieving evidence in a civil case . Postponing the search for statements until the last session is dangerous: the bank may have a limited period of storage of certain data, and the court may reject an untimely request without good reason.

How are shares determined if personal and joint funds were used?

Not every apartment has only one regime. Part of the price could be covered by the sale of personal property, and the rest was paid by the spouses from joint income or a loan they repaid during the marriage. In this case, the requirement to recognize the entire apartment as personal may be too high, and the requirement to divide it in half may ignore the proven personal contribution.

The court must establish the total purchase price, the amount of proven personal funds, and the source of the remainder. The portion paid with personal funds may belong to the spouse who contributed them. The portion paid with joint funds remains the subject of joint joint property and is generally divided equally. The specific method of defense depends on the claims, evidence, composition of the total property, and the ability to determine the shares.

The conditional calculation shows the logic, but does not replace the court's assessment. If the apartment cost 3,000,000 UAH, 2,000,000 UAH came from the sale of proven personal real estate of one of the spouses, and 1,000,000 UAH were joint, the personal part is 2/3. The joint 1/3 is generally distributed equally. Then the mathematical benchmark for the person who contributed personal funds is 5/6, and for the other spouse 1/6. The court will check not only the arithmetic, but also the reality of each source and the content of the stated claims.

The loan requires a separate analysis. The date of conclusion of the contract, the borrower, the purpose of the loan, the actual use of the funds, the source of the down payment and the repayment of the debt are important. The fact that the loan is issued to only one of the spouses does not automatically prove the personal nature of the purchased apartment. Similarly, repayment after the dissolution of the marriage cannot be mechanically equated with a change in registered shares without analyzing the obligations and claims of the parties.

The price in the old contract and the current market value should not be confused. The origin of the funds is usually compared with the purchase price at the time of the transaction. For the division, compensation or distribution of several objects, an up-to-date valuation may be required. If monetary compensation is claimed, it is necessary to correctly formulate the method of protection and take into account the requirements of Article 71 of the Civil Code of Ukraine regarding the division of indivisible things.

The best result is not the maximum share on paper, but a claim that is confirmed by payments and that is consistent with the procedural method of protection. Before filing a lawsuit, it is worth separately checking the composition of the property, possible counterclaims, security for the claim, and the consequences of the alienation of the apartment during the dispute.

What to do before purchasing or starting a dispute

Before purchasing a home, it is safer to make a payment through a bank and not mix personal money with current family income. The purpose of the payment should correctly indicate the contract or object. Personal property sales contracts, bank statements, and documents about a new purchase should be kept together. If part of the money is donated by parents, written registration and a non-cash transfer significantly reduce future uncertainty.

Spouses can regulate the property regime by agreement. Depending on the moment and purpose, this may be a marriage contract, a division agreement, an allocation agreement, or another notarial agreement permitted by law. Such a decision requires individual verification, because the agreement should not put one of the spouses in an extremely disadvantageous financial situation, and real estate transactions must meet the requirements for form and registration. A service for preparing contracts in family law may be appropriate even before the conflict arises.

If the dispute has already begun, it is necessary to quickly record the evidence. It is worth obtaining information from the registers, copies of notarial documents, complete bank statements, credit file, confirmation of currency transactions and property valuation. It is necessary to check whether the apartment is being foreclosed, and if there is a real risk, consider securing the claim. The conflict between the former spouses alone without evidence of an intention to sell or hide the property does not guarantee the application of restrictions.

For claims for division of property after divorce, Article 72 of the Civil Code of Ukraine establishes a three-year limitation period, but its running does not automatically begin on the day of divorce. The period is calculated from the day when the person learned or could have learned about the violation of his property rights. The date of the violation and the moment of awareness must be proven taking into account correspondence, denial of access, attempted sale, registration actions or other specific events.

Lawyers "Your Lawyer" can check the legal status of the apartment, restore the chain of payments, determine reasonable shares and prepare a claim or objection. The earlier contracts and bank documents are collected, the less the dispute depends on the parties' memory and assumptions.

FAQ

If the apartment is registered in the name of the husband, does the wife have the right to it?

If the apartment was purchased during the marriage, there is a presumption of joint ownership regardless of whether it is registered in the name of one of the spouses. This presumption can be rebutted by evidence of a personal source of funds or other legal basis.

Is it enough to sell your premarital apartment on the day you buy a new one?

The proximity of the dates is important, but the court also evaluates the amounts, the method of calculation, the flow of funds, and other documents. It must be shown that the money from the sale of personal property was actually sent to the seller of the new apartment.

Is money in a personal account personal property?

Not always. If the account was funded with income earned during the marriage, such funds may be joint. What matters is the origin of the money, not just the name of the account holder.

What happens if part of the apartment was paid for with personal funds and part with joint funds?

The court may distinguish between the personal and joint parts based on the proven ratio of contributions. The joint part is generally divided equally, unless there are grounds for a different division.

Is it possible to reach an agreement without going to court?

Yes. Spouses or former spouses may enter into a properly executed property division agreement or other permissible arrangement. For real estate, the notarial form and state registration rules must be followed.

When does the deadline for dividing an apartment after a divorce expire?

A three-year statute of limitations applies to claims for division of property after divorce. It begins to run from the day the person learned or could have learned of the violation of their right, and not automatically from the date of divorce.
